The couple were charged under a 2004 invasion of privacy law aimed at people who used technology to secretly record personal images of others.
Lawyers for Lawrence Kane of Chatham and his girlfriend, Ruth Kohn of Livingston, contended the law was being misused because there is no presumption of privacy in a public place. The judge disagreed."
